DMCA Notices & Counter-Notices
Halo Privacy respects the intellectual property rights of others and expects users of haloprivacy.com to do the same. This page describes how to submit a notice of alleged copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and how to submit a counter-notification.
1. How to submit a notice
If you believe content available on or through the Site infringes a copyright you own or are authorized to enforce, send a written notice to our designated agent at the address below. To be effective under the DMCA, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are involved).
- Identification of the material claimed to be infringing, with enough detail to let us locate it (a URL is usually best).
- Your contact information, full name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Notices that fail to include all six elements may not be effective.
2. Designated agent
Send DMCA notices to:

3. Counter-notification
If you believe content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to the address above. To be effective, a counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, the federal court for any judicial district in which Halo Privacy may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.
4. Repeat infringer policy
It is our policy, in appropriate circumstances, to terminate access for users who are repeat infringers.
5. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Don't make false claims.
